Let’s break it down
What Is an International Trademark?
While there’s no single global trademark that protects your brand in every country, the Madrid Protocol makes it easier to apply for trademark protection in multiple countries with one application.
You start with a USPTO trademark, then extend protection to over 130 countries that are part of the Madrid System.
Step-by-Step: How to Register a Trademark Internationally
1. Start with a U.S. Trademark Application or Registration
Before you can go international, you need a USPTO-filed trademark. This becomes the “base” for your international application.
2. Choose the Countries You Want to Protect Your Trademark In
You can select one or multiple Madrid Protocol member countries. Think about your markets—like Canada, the UK, EU, China, India, or Australia.
3. File Through the USPTO Using the Madrid Protocol
Submit your international application through the USPTO, which forwards it to the World Intellectual Property Organization (WIPO).
4. WIPO Reviews and Sends to Each Country
Each country’s IP office will then review your application individually.
5. Maintain and Monitor
Once approved, you’ll need to monitor, renew, and defend your trademark in each selected country.
